Terms & Conditions

01Acceptance of Terms

These Terms & Conditions ("Terms") govern your application for and use of the LVL Privé membership at MVCC (Club LVL), also branded as "Club Level" and "LVL:MVCC," located at 8 Hampshire Street, Lawrence, Massachusetts (the "Venue"). The Venue is operated as a private membership association.

By submitting the signup form, presenting identification at the host stand, accepting issuance of a Privé card, or entering the Venue as a member, you agree to be bound by these Terms, our Privacy Policy, and our Membership Agreement. If you do not agree to any of the foregoing, you may not apply for or hold a Privé membership.

02Membership Eligibility

To be eligible for a Privé membership you must:

Submission of materially false information, including fraudulent identification, voids the membership ab initio and may be reported to law enforcement.

03Privé Membership

The Privé membership is a personal, non-transferable license to enter the Venue as a member of the association during the term stated at issuance, subject to these Terms and to space, capacity, and event-specific conditions.

Term and Renewal

Unless otherwise stated at issuance, a Privé membership is valid for twelve (12) months from the date of approval and does not automatically renew. Continued access after expiration requires reapplication or renewal, which may be subject to revised terms.

Non-Transferability

Memberships and Privé cards are personal to the named member, may not be loaned, gifted, sold, traded, or otherwise transferred, and confer no admission rights upon any other person. A member may not use a Privé card to bring an unverified guest past the host stand other than under a guest policy expressly stated by the Venue.

Card Issuance and Replacement

Privé cards are issued at the host stand only after in-person verification of the member's identification against the information submitted in the signup form. Lost, stolen, or damaged cards may be reissued upon re-verification, subject to a replacement fee at the Venue's discretion.

No Guarantee of Admission

A valid Privé membership confers eligibility for admission. It does not guarantee admission on any given night. Admission may be denied or delayed for capacity, dress-code, conduct, safety, special-event, or any other reasonable operational reason, including reasons reserved entirely to the Venue's discretion.

04Member Conduct

The Venue maintains a code of conduct designed to preserve the safety, dignity, and enjoyment of all members and guests. Members agree to:

05Right to Refuse Entry & Service

The Venue reserves the right, in its sole and reasonable discretion, to refuse entry to or eject any person, including a Privé member in good standing, for reasons including but not limited to apparent intoxication, disorderly or threatening conduct, violation of these Terms, violation of posted rules or dress code, refusal to comply with staff directions, or any reason permitted by applicable law.

Refusal of entry under this section does not entitle the affected person to a refund of any fee or membership dues, partial or otherwise.

06Suspension & Revocation of Membership

The Venue may suspend or permanently revoke a Privé membership at any time for cause, including but not limited to:

Revocation is effective upon notice to the member, which may be delivered in person, by email to the address on file, or by posting at the host stand. A revoked member who attempts to re-enter the Venue may be treated as a trespasser.

07Alcohol & Substances

The Venue is licensed and regulated. Members and guests must be of legal drinking age to be served alcoholic beverages, must present valid identification upon request, and must not consume alcohol or any substance brought onto the premises from outside.

The Venue reserves the right to limit or refuse service in compliance with the Commonwealth of Massachusetts dram-shop and alcohol-licensing laws, and to require any person who is or appears to be intoxicated to leave the premises. Members agree not to drive while impaired and agree to use rideshare, taxi, designated-driver, or public-transportation alternatives when appropriate.

08Photography & Recording on Premises

By entering the Venue, you acknowledge and agree that:

If you do not wish to be recorded, your only remedy is to refrain from entering the Venue.

09Assumption of Risk

You acknowledge that a nightlife venue is an inherently energetic environment. Hazards may include, but are not limited to: high-volume music; flashing or strobe lighting; crowded conditions; physical activity including dancing; slippery floors due to spilled beverages or weather conditions; the conduct of other patrons; the consumption of alcohol by other patrons; smoke or vapor in designated private-club areas where permitted by law; and the use of pyrotechnic or special-effect equipment at certain events.

You knowingly and voluntarily assume all risks associated with your presence on the premises and acknowledge that you are physically and medically able to be present. See also our Membership Agreement, which is incorporated into these Terms by reference.

10Lost or Damaged Property

The Venue is not responsible for the loss, theft, or damage of any property brought onto the premises, including but not limited to clothing, mobile devices, handbags, wallets, identification documents, vehicles, and the contents of any coat check, locker, table, or vehicle. Use of any coat check, locker, or storage area is at the member's sole risk and does not create a bailment.

11Intellectual Property

The "LVL," "LVL:MVCC," "Club Level," and "Privé" names, logos, marks, and trade dress are the intellectual property of the Venue or its licensors. Nothing in these Terms grants any member a license to use those marks for any commercial, promotional, or derivative-content purpose without express prior written authorization. Member content posted to public social media that references the Venue is governed by the host platform's terms.

12Limitation of Liability

To the fullest extent permitted by applicable law, the Venue, its owners, officers, directors, employees, agents, contractors, licensors, and affiliates (collectively, the "Venue Parties") shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your membership, your presence on the premises, or these Terms, whether based in contract, tort, negligence, strict liability, or otherwise, and even if a Venue Party has been advised of the possibility of such damages.

In no event shall the aggregate liability of the Venue Parties to you for any and all claims arising out of or related to these Terms exceed the greater of one hundred United States dollars (US$100.00) or the total amount of membership fees actually paid by you to the Venue in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the foregoing limitations may not apply to you.

13Indemnification

You agree to indemnify, defend, and hold harmless the Venue Parties from and against any and all claims, demands, suits, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your conduct on the premises, (c) your violation of any applicable law, or (d) your violation of any third-party right, including any right of publicity, privacy, or intellectual property.

14Disputes & Arbitration

The parties shall first attempt in good faith to resolve any dispute arising out of or related to these Terms through informal negotiation. If a dispute cannot be resolved within thirty (30) days of written notice from one party to the other, the dispute shall be referred to binding arbitration administered by a recognized arbitration provider seated in Boston, Massachusetts, applying the laws of the Commonwealth of Massachusetts and the Federal Arbitration Act.

Each party shall bear its own attorneys' fees and shall split the administrative and arbitrator's fees equally, unless the arbitrator determines otherwise. The arbitrator's decision shall be final and binding. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights or to enforce an arbitration award.

Class action waiver. To the maximum extent permitted by law, the parties waive any right to participate in a class, collective, or representative action against the other and agree that any arbitration shall be conducted only on an individual basis.

15Governing Law & Venue

These Terms and any dispute arising out of or related to them shall be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws provisions. Subject to Section 14, the exclusive forum for any judicial proceeding shall be a state or federal court of competent jurisdiction located in Essex County, Massachusetts, and the parties consent to the personal jurisdiction of those courts.

16Severability & Entire Agreement

If any provision of these Terms is held to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and the Membership Agreement, constitute the entire agreement between you and the Venue with respect to the subject matter and supersede all prior or contemporaneous communications, agreements, or understandings.

17Changes to Terms

The Venue may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the date of most recent revision. Material changes will be communicated by reasonable means, which may include a notice on this site, an email to the address on file, or posted notice at the host stand. Your continued membership after the effective date of any revised Terms constitutes your acceptance of the revised Terms.
