Membership Agreement

01Membership Exclusivity

MVCC (Club LVL) is a MEMBERS ONLY club and is not open to the general public. Access, events, and privileges are strictly reserved for verified members.

02Indemnification Clause

By signing this Agreement, the member agrees to indemnify, defend, and hold harmless MVCC (Club LVL), its owners, employees, and affiliates from any claims, liabilities, damages, or expenses arising from any incident occurring inside or outside the establishment, including but not limited to personal injury, property damage, or legal disputes.

03Membership Revocation

MVCC (Club LVL) reserves the right to immediately revoke membership for any violation of the club's Code of Conduct. Violations include but are not limited to disruptive behavior, illegal activities, or failure to adhere to club policies.

04Compliance with Laws & Regulations

All members, guests, and operations within MVCC (Club LVL) must comply with the laws of the Commonwealth of Massachusetts, including but not limited to:

• Alcoholic Beverages Control Commission (ABCC) regulations;
• NFPA codes and standards (National Fire Protection Association);
• Local Licensing ordinances;
• Local Health Board regulations.

Failure to adhere to applicable laws or regulatory requirements may result in disciplinary action, including membership revocation or legal consequences.

05Non-Discrimination Policy

MVCC (Club LVL) is committed to fostering an inclusive environment. Membership and participation in club activities shall not be restricted or denied based on race, national origin, sexual orientation, gender identity, religion, or disability.

06Tobacco & Related Products Policy

MVCC (Club LVL) does not sell tobacco or tobacco-related products. Members are permitted to consume their own tobacco products within the club, provided they do so in accordance with all state and local regulations. MVCC (Club LVL) does not encourage or promote the consumption of tobacco.

07Confidentiality Clause

Members agree not to disclose proprietary or sensitive club-related information to non-members or external parties without prior approval.

08Liability Waiver

MVCC (Club LVL) is not responsible for any injuries, damages, or losses incurred during club activities, events, or while on club property. Member knowingly and voluntarily assumes all risks associated with attendance at the club, including but not limited to risks associated with crowds, dancing, high-volume audio, lighting effects, ambient tobacco smoke in permitted areas, and the conduct of other members or guests.

09Code of Conduct Enforcement

MVCC (Club LVL) may conduct investigations into alleged violations of the Code of Conduct. Members found in violation may be subject to suspension or permanent expulsion at the discretion of club leadership.

10Conflict of Interest Clause

Members must avoid activities that create conflicts with MVCC (Club LVL)'s mission or operations. Engaging in actions that undermine the club's integrity may result in membership termination.

11Financial Responsibility Clause

Members agree to pay all dues, fees, and outstanding balances promptly. Late payments may result in penalties or suspension of membership privileges.

12Alcohol Consumption Policy

If alcohol is permitted at club events, members are expected to drink responsibly. MVCC (Club LVL) assumes no liability for alcohol-related incidents or damages. Members must be of legal drinking age and may be required to re-present valid identification upon request.

13Dispute Resolution Clause

Any disputes between members and MVCC (Club LVL) shall be resolved through good-faith mediation, and if mediation fails, through binding arbitration, rather than litigation. Mediation and arbitration shall be seated in Essex County, Massachusetts, unless the parties mutually agree otherwise.

14Termination Clause

In the event that MVCC (Club LVL) must dissolve or alter its operational structure, all members will be notified, and appropriate procedures will be followed.

15Media & Photography Release

Members grant MVCC (Club LVL) permission to use images, videos, and other media featuring them for promotional purposes, unless they opt out in writing.

Opt-out procedure

To opt out, a member must send written notice to legal@clublvllawrence.com stating the member's full name, member number (if known), and email address on file, with the subject line "Media Opt-Out." Opt-out takes effect upon confirmation from MVCC (Club LVL) and applies prospectively. Recordings captured before the effective date of the opt-out may continue to be used.

16Free Speech & Inclusivity Policy

MVCC (Club LVL) is a safe space for the exchange of free speech and ideas. Members are encouraged to engage in thoughtful discussions without fear of judgment. The club actively fosters diversity, equity, and inclusion, ensuring that all members feel welcome, respected, and valued in their contributions to the community.

17Club Capacity Policy

Membership in MVCC (Club LVL) does not guarantee entrance to the club if the venue has reached capacity. Once capacity is met, entry will be restricted to maintain safety and compliance with regulations. Members are expected to respect club capacity limits and adhere to any entry restrictions put in place by club management.

18Drugs & Weapons Prohibition

Drugs and weapons of any kind are prohibited and are grounds for immediate revocation and permanent expulsion from MVCC (Club LVL).

19Age Affirmation

Member affirms under penalty of misrepresentation that Member is twenty-one (21) years of age or older as of the date of acceptance of this Agreement. MVCC (Club LVL) relies on this affirmation in granting membership and admission. Any misrepresentation of age voids the membership, voids this Agreement, and may subject Member to criminal liability under applicable law.

20Acknowledgment & Agreement

By accepting this Agreement, Member acknowledges that Member has read, understood, and agreed to abide by the terms outlined in this disclosure.

21Electronic Signature

Member acknowledges and agrees that by submitting the LVL Privé signup form, marking the acceptance checkbox associated with this Agreement, or presenting identification at the host stand following an online submission, Member is signing this Agreement electronically pursuant to the federal Electronic Signatures in Global and National Commerce Act ("E-SIGN") and the Uniform Electronic Transactions Act as adopted in Massachusetts. Such electronic signature has the same legal force and effect as a handwritten signature.

Member further acknowledges that MVCC (Club LVL) may rely on records of Member's acceptance — including server timestamps, submission identifiers, and IP addresses — as evidence of Member's agreement to this Agreement. A copy of this Agreement, as in effect on the date of acceptance, will be retained by MVCC (Club LVL) and made available to Member on written request.

22Governing Law & Survival

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws provisions. If any provision of this Agreement is held to be unenforceable, the remaining provisions shall continue in full force and effect. The releases, waivers, indemnifications, and licenses granted under this Agreement shall survive the termination of Member's membership and Member's presence at the club.
